With the advent of the 4th Industrial Revolution, international discussions on intercourse with artificial intelligence robots are actively being conducted. In this respect, it is necessary to discuss human sexual freedom related to adult robots. In this paper, we examined the fundamental rights and the obligations of the state in the Korean Constitution. In terms of the right to liberty, it was revealed that the sexuality with the robot is distinct from the existing human sexuality. And as a new type of sexual freedom that emerged in the field of life extended by the advancement of technology, and incorporated it into the content of fundamental rights. In addition, through Articles 10 and 37 of the Constitution, the government reiterated the obligation to actively affirm and guarantee the rights not expressly provided for in the Constitution. Also, the concept of marriage and family guaranteed by Article 36 of the Constitution has been removed from the existing viewpoint and raised the necessity to look from an advanced point of view, and it opened the possibility of accepting the robot as one of family members. Therefore, we clearly identify the area of sexual freedom with adult robots and recognize it as a right, and we think it is desirable for the state to actively protect it.
