Disasters are on the increase which threatens human beings of their rights to safe life. It can be classified into two types natural and social disaster by Framework Act on Disaster and Safety Management. Vulnerable groups may include individuals with disabilities, pregnant women, children, elderly persons, certain members of ethnic minorities, people with language barriers, and the impoverished. Individuals with physical disabilities may be underserved in a variety of ways during a disaster. They were adversely affected in terms of their physical safety and access to immediate aid, shelter, evacuation and relief. Economically and socially disadvantaged individuals are likely to suffer disproportionate harm from disasters because they lack resources and adequate support systems. In this paper, I suggest improvement of legal that establish nondiscrimination mandates and other obligations that State has towards vulnerable group in disaster. It is necessary to legislate specific regulations on the constitutional right to safety by the National Assembly. Disaster insurance is a form of property insurance that pays the policyholder in the event that a natural disaster causes damage to the property. The fund of disaster insurance depend on the object, while the insurance coverage will be determined through legislation for vulnerable group. Disaster messages(CBS; Cell Broadcasting Service) should be sent to foreigners in various languages. By checking the message, they can know about the current emergency situations and how to respond to them.

재난이란 국민의 생명?신체?재산과 국가에 피해를 주거나 줄 수 있는 것으로, 언제나우리의 주변에서 발생할 수 있고, 재난과 안전관리기본법상 자연재난과 사회재난으로 구분할 수 있다. 국가와 지자체는 재난 등으로부터 국민의 생명?신체 및 재산을 보호할 책무를 지고, 재난이나 그 밖의 각종 사고를 예방하고 피해를 줄이기 위하여 노력하여야 하며, 발생한 피해를 신속히 대응?복구하여야 한다. 특히 안전취약계층은 어린이, 노인, 장애인, 저소득층 등 신체적?사회적?경제적 요인으로 인하여 재난에 취약한 사람으로서 재난에 대응하거나 피해를 복구하는데 있어 신체적 조건과 이성적 판단이 부족하므로 재난안전취약계층은 다른 계층에 비해 훨씬 재난에 취약하다. 따라서 재난안전취약게층에 대한 체계정합적인 법령상의 정의와 함께 그들의 생명과 재산을 보호하기 위한 조치가 적절하게 이루어져야 한다. 이러한 기본개념을 바탕으로 본 논문에서는 재난안전취약계층의 특성을 기술하고 이들의 특성에 맞는 입법정책적 개선방안이 이루어져야 한다. 우선 헌법상에 안전권에 관한규정을 명하여 국민의 안전권을 기본적인 권리로 보장하고, 헌법소송을 통해 권리를 구제받을 수 있도록 해야 한다. 또한 재난안전취약계층만을 위한 재난보험제도를 도입하여 재난안전취약계층에 대한 실질적인 지원이 이루어지도록 해야 한다. 끝으로 국가 또는 지자체가 재난문자를 발송하는 경우에 장애인의 특성에 맞는 시스템을 개발하여 재난정보에있어서 소외되지 않도록 해야 한다. 또한 외국인들의 재난안전을 위해 다양한 언어로 재난문자가 발송되어야 한다, 재난안전취약계층을 위한 입법적 개선은 결국은 이들에 대한 안전권 보장과 더불어 인권의 보장이다.
