This study reviews the discussions so far on the presence and development directions of the workers" representative system in Korea. This is because the labor union, which exists as a traditional representative of workers, is not granted the status of representative of the entire workplace under the legal system. Even though the position as a representative is granted by law, there are cases in which it exerts its influence on the overall working conditions of the workplace. In other words, there are many discrepancies between the system and reality. However, there is a phenomenon in which legal arrangements regarding the system have not been made, and the use of the system itself is avoided. In particular, with the decline in the union organization rate, the discussion on the workers" representative system as an alternative collective representation system continues, but its development is still slow. Therefore, by examining the existing research on the presence of the system and the future development direction, it is intended to function as a preliminary review of the future direction of the workers" representative system. And, among the various statutory systems of workers" representatives, the labor-management council under the Act on the Promotion of Worker Participation and Cooperation and the workers" representatives under the Labor Standards Act were mainly reviewed.
Each of the contents reviewed in this study has a logical and practical basis. However, the practical validity of such contents can only be judged by examining the progress of implementation after actual implementation. In addition, although these discussions are determined and operated by legislation, it will not be easy to achieve the legal intentions without the opinions and agreements of the parties and efforts between labor and management for the realization of the system. Therefore, in relation to the workers" representative system, it should not focus only on flexibility through collective representation or prompt agreement and operation of workplace decisions. In addition to the current discussion, a more delicate and step-by-step approach is needed under the broad framework of collective industrial relations.
