Human dignity is the ultimate reason and the highest ideology of the Constitution. It is the highest norm in Republic of Korea that binds all national institutions. However, it is almost impossible to understand the fundamental meaning of human dignity unless we are God. As a result, human dignity virtually lost its normative function and fell into a decorative language. This study seeks to exert the normative function of human dignity by finding ‘condition’ rather than ‘meaning’ of human dignity. In this study, first, the conditions of human dignity are divided into necessary condition, and sufficient condition. And safety was assumed as a necessary condition for human dignity. Second, safety means we are out of risk, so we first need to understand the concept of risk. Therefore, the concept of risk from the perspective of law and the type of risk from the perspective of sociology were considered. In other words, risks were divided into probable risk(danger) and possible risk(risk) according to the degree of uncertainty of the damage. The types of risk is largely categorized into disaster risk, security risk, wage labor risk, and new risk according to the age category. Third, based on the above-mentioned risk concept and type, the concept of safety is grasped and the type is summarized, and based on this, the safety rights were defined and examined whether they could be recognized as fundamental rights, and then the types of safety rights were presented. Fourth, The government's obligation to guarantee safety rights and its evaluation criteria were reviewed. If the study on the necessary and sufficient conditions of human dignity scheduled as a follow-up to this study is successfully completed, human dignity can serve as a concrete standard for legal interpretation and judgment.
