According to the National Human Rights Commission of Korea’s survey on the hate and discrimination against transgender people, only 47 (8.0%) of the 591 respondents completed legal gender recognition. The reason is due to the current strict standards and procedures for legal gender recognition. In 2006, the Supreme Court approved the legal gender recognition of transgender people, and in the same year, the Supreme Court established the regulation about the criteria and procedures for gender recognition. However, the Supreme Court's criteria is too strict, including sterilization, genital surgery, not being married, and having no minor children. On the procedural side, various complicated documents are required and insulting questions are sometimes asked by judge. Everyone shall have the rights to recognition everywhere as a person before the law. Nevertheless, most korean transgender people are not guaranteed such rights. On the other hand, legal gender recognition is basically a matter of legislation in that it determines the legal status of gender. Therefore, the National Assembly and the Government have to enact a law on legal gender recognition. This paper propses to enact law on legal recognition of gender, which is reflects the latest medical and social discussions on transgender people and stipulates “fast, clear and accessible legal gender recognition procedures based on self-determination” under international human rights standards.

2021. 2. 9. 발표된 국가인권위원회의 트랜스젠더 혐오차별 실태조사에 따르면 응답자 591명 중 법적 성별정정을 완료한 사람은 47명(8.0%)에 불과했다. 신분증상 성별과 성별정체성의 불일치로 트랜스젠더들이 많은 차별을 받음에도 실제로 성별정정을 하는 비율이 낮은 이유는 현재의 엄격한 성별정정 기준과 절차로 인해서이다. 2006년 대법원은 전원합의체 결정을 통해 트랜스젠더의 성별정정을 허가했고 같은 해 대법원 예규를 제정하여 성별정정의 기준과 절차를 제시했다. 그러나 대법원이 제시한 기준은 생식능력 제거수술을 포함한 성전환수술을 마칠 것, 혼인 중이 아닐 것, 미성년 자녀가 없을 것 등 지나치게 엄격하여 많은 트랜스젠더들이 이를 충족하지 못하고 있다. 또한 절차에 있어서도 여러 복잡한 서류들을 요구함에도 구체적인 정보가 제공되지 않고 법원에 따라 심문과정에서 모욕적인 질문들이 이루어지기도 한다. 모든 사람이 법 앞에 온전한 개인으로 존중받는 것은 성별정체성에 상관없이 동등하게 보장되어야 하는 권리이다. 그럼에도 대법원 결정 후 15년이 지난 지금까지도 대다수의 트랜스젠더가 이러한 권리를 보장받지 못하는 지금의 상황은 개선될 필요가 있다. 한편 성별정정은 성별이라는 법적 지위를 결정하는 문제라는 점에서 기본적으로는 입법사항이다. 따라서 근본적인 개선을 위해서는 국회와 정부가 성별정정에 관한 법률을 제정할 필요가 있다. 이에 이 논문에서는 트랜스젠더에 대한 최신의 의학적·사회적인 논의를 반영하고 국제인권규범에 따른 ‘자기결정에 기반한 신속, 명료, 접근가능한 절차’를 규정한 법률로서, 성별의 법적 인정에 관한 법률을 제정할 것을 제안한다.
