자원봉사란 자발적으로 자신의 시간과 에너지를 투입하여 다른 사람 또는 국가와 사회를 위해 돕는 일을 말한다. 그런데 현행 자원봉사활동 기본법에 근거하여 시행되는 자원봉사활동에는 여러 가지 문제점이 제기되고 있다. 우선, 국가의 자원봉사 정책의 실효성(이행율)이 저하되고 있다. 그 이유로는 국가의 자원봉사행정의 체계성 부족, 각 부처 간의 정책의 상이, 그리고 민・관협력체계 미흡, 전문성 부족 등이다. 그리고 자원봉사자의 참여율이 점점 감소되고 있다. 이는 자원봉사자들의 관심부족과 비자발적인 자원봉사로 인해 단발성 봉사에 그치고 있다는 것이다. 또한 자원봉사를 빙자하여 정치활동이 자행되고 있다. 즉 선거자원봉사에 있어서 자원봉사의 허용행위와 금지행위가 불분명하고 그 위반행위에 대한 법적 제재도 약한 실정이다. 그 밖에 지방자치단체 별 자원봉사센터의 자율성이 부족하다는 것이다. 지방자치단체의 재정지원으로 인한 행・재정적 관리・감독이 권력적・규제적 형태로 나타나 자원봉사의 의미를 퇴색시키고 있다. 아울러 자원봉사활동 중 부득이 발생한 사고에 대하여 ‘봉사활동’으로 인정을 못 받거나 보상이 제대로 이루어지지 않고 있는 실정이다. 이와 같은 문제점에 대한 개선방안으로 첫째, 국가의 자원봉사 정책의 체계화로 합리성을 도모해야 할 것이다. 자원봉사 정책수립 과정에서 각 부처의 통일적인 체계 수립과 정책집행에서 민·관 협력체제 강화와 자원봉사의 전문화 등이 요망된다. 둘째, 자원봉사자의 참여를 증대시키기 위한 자원봉사의 기본가치 확립이 중요하다. 자원봉사에 대한 시민적 가치를 범국민 차원에서 공유하도록 하고 사회문제 해결과 전체 시민사회 발전을 도모해야 할 것이다. 셋째, 선거자원봉사자의 공정선거활동이 이루어져야 하는바, 선거자원봉사자의 공직선거법상 정치적 중립성이 보장되어야 한다. 즉 자원봉사자의 선거운동 허용행위와 금지행위를 설정하고 만일 공직선거법에 위반한 경우에는 엄격한 법적 제재를 가하는 것이 필요하다. 넷째, 각 자원봉사센터의 자율성 확보가 중요하다. 즉 자원봉사센터의 설치・운영, 자원봉사자 관리, 자원봉사자 교육, 민·관의 협력체제 확립, 그리고 자원봉사 센터 사업의 기획, 운영, 평가 등 전 과정에 걸쳐 자율성이 확보되어야 한다. 다섯째, 자원봉사자가 자원봉사활동에서 부득이 발생하는 각종 재해로부터 보호받도록 해야 한다. 자원봉사자는 반드시 상해보험에 가입하고 위험에 대한 만약 재해발생 시에는 적극 보상을 실시해야 한다. 아울러 재해발생에 대한 자원봉사활동의 실효성 확보를 위해서는 무엇보다도 충분한 예산의 확보가 필요하다.

Volunteer work refers to work for a person, country, or society by investing one’s time and energy willingly and autonomous. However, there have been some issues in volunteer works based on the current fundamental law. First of all, the effectiveness (or rate of practice) of the volunteer work is deteriorating. This is caused by the lack of structured system in the administration of volunteer work, conflicting policies between departments, insufficient cooperation between the private and public sector, and the lack of expertise. Furthermore, the rate of participation of volunteers is decreasing. This is caused by a lack of interest in volunteering work in the public which make most of the volunteers involuntary and temporary visitors. In addition, some volunteers have the ulterior motive to do political activities in the name of volunteering. The prohibition and permission of political activities become vague when it comes to volunteering work, and there are fewer cases where the legal penalty is practiced for violation. Other reasons for the decreased effectiveness is the lack of autonomy of volunteer centers in local governments. The administrative and financial management and control by the local government are practiced in the form of authority and regulation. Furthermore, there have been a few cases where participants could not certify their volunteer work or failed to receive compensation in the case of an accident. Therefore, to resolve these issues, first of all, the volunteering policy should be legitimized through systemization. Establishing a unified system in each department in the process of policing is a must coupled with strengthening cooperative system between the private and public sector and specializing in the relevant field. Second, it is important to define the fundamental values of volunteering to increase the participation of volunteers. At the national level, the value of volunteering work must be promoted for citizens, encouraging the value as a way of solving social problems and to develop a civil society. Third, the political neutrality must be guaranteed for the volunteers for the election according to the Public Official Election Act. In other words, the permitted and prohibited activities in the election campaign must be defined clearly while any violation of the regulation leads to a strict legal penalty. Fourth, it is important to secure the autonomy of volunteering centers. It is crucial to secure autonomy in all processes of implementing and operating volunteering centers, managing and training volunteers, and establishing a cooperative system between the public and private sector. Fifth, the volunteers should be protected from unavoidable or unpredictable accidents during the volunteering activities. The volunteers should be covered by accident insurance mandatorily, have preparatory training on risks, and receive sufficient amount of compensation in the case of accidents. Moreover, strengthening the effectiveness of the volunteering work requires securing of sufficient budget.
