Jurisdiction over vessel-source pollution has been traditionally in the hands of flag States. However, it is coastal States that suffer most directly from vessel-source pollution and thus that have the greatest interest in preventing that source of marine pollution. Bearing this in mind, this article purports to examine the legal basis and substance of the coastal State jurisdiction over vessel-source pollution. In internal waters where coastal States enjoy full territorial sovereignty and thus plenary jurisdiction, they may regulate the access to those waters by foreign ships on the grounds, amongst others, of environmental considerations. In addition, coastal States have legislative and enforcement jurisdiction over ships lying in internal waters in pollution matters. In the territorial sea where their jurisdiction is restricted by the right of innocent passage, coastal States may, nevertheless, enact and enforce anti-pollution laws and regulations against foreign ships enjoying the right of innocent passage. Further, the right of innocent passage can be forfeited by polluting activities. In the contiguous zone, however, coastal States do not have any authority to enforce environmental regulations. However, this situation can be offset by the regime of exclusive economic zone because coastal States are given the power to regulate vessel-source pollution in this maritime area. The anti-pollution jurisdiction of coastal States in the exclusive economic zone is formulated in terms of the accommodation between the interests of the coastal States and those of international navigation.
