The superficies-right in Korea, one of the real rights, is to rely upon legal changes of things at earth's surface, because it is not a right to persons but one of the real rights for use. These Korean circumstances are deferent not only from those of Continental nations like Germany and France who regard the superficies-right as a right to things at earth's surface but also those of U.S.A. and England who settle the related matter by rent. From these particular circumstances in our country, the Supreme Court of Korea has been sentenced successively the point that the superficies-right moves dependently according to the move of the right to things at the earth's surface, although the cases are not about the superficies-rights generally but about the legal superficies-right. These cases are the results from the dependency of the superficies-right as the internal and natural characteristic, I think. This essay, by survey and study at historical and comparative view-points, argues that the superficies-right is naturally and generally dependent upon the legal changes of things at earth's surface. This essay, by study of legal theory, confirms the scope of the dependency as possible as granted. And this essay contains the present position and desirable attitudes of the Court, which have been certificated by survey of some leading cases and prospected in the future, regarding the dependency of the superficies-right. Finally there is presented my opinion of legislation according to the superficies-right in Korea.
