The ｢Act on Special Cases concerning the Settlement of Traffic Accidents｣ aims to facilitate a prompt recovery of damages caused by traffic accidents and to promote convenience for people's everyday life by providing special cases on criminal punishment for drivers involved in traffic accidents through occupational or gross negligence. The Act, however, gives rise to create a moral hazard for drivers, by restricting prosecutions of specific cases. It is against criminal justice to restrict prosecutions of the drivers who commits crimes by infliciting bodily injury through gross negligence of the crime relating to traffic accidents by reasons of insurance or mutual aid association. It is desirable to enable prosecutors to prosecute the drivers who commit crimes by infliciting serious bodily injury, even if the vehicles concerned are covered by insurance or mutual aid association. The latest constitutional court's decision is thought to have the same intents. The question is the scope of "serious bodily injury". The ｢Criminal Act｣ provides "serious bodily injury" as infliciting bodily injury upon another, thereby endangering ones life or causing one to be crippled or incurably or hopelessly diseased. Under ｢Criminal Act｣, "serious bodily injury" is a grounds for aggravated punishment. On the contrary, under ｢Act on Special Cases Concerning the Settlement of Traffic Accidents｣, "serious bodily injury" is a grounds for prosecution. Therefore, the concept of "serious bodily injury" under ｢Act on Special Cases Concerning the Settlement of Traffic Accidents｣ is needed to be defined more definitely and clearly than the concept of "serious bodily injury" under ｢Criminal Act｣.
