The purpose of this study is to analyze the differences between NoGun-Ri massacre & Op. Heungnam withdrawal during the Korean War regarding dealing with refugees and learn a lesson from it. NoGun-Ri massacre is the incident that lots of civilians were killed or injured by the US Army on the way of retreat. Op. Heungnam withdrawal is the largest withdrawal action at sea in the history. The combined forces had to pull out of Heungnam because of participation of Chinese troops. In the process of carrying out the operation, Refugees of nearly one hundred thousand tried to evacuate and follow the troops. The lessons are as follow. First, it takes commander's effort to protect civilians' lives & human rights. Second, in the aspect of military strategy, armed forces needs to consider how to control refugees, how to hunt out spies among refugees and how to accept North korean defectors. Third, in war time, civilians must be protected and war crimes like civilians massacres must be prevented. Fourth, soldiers should be aware of the purpose of the military : protecting people's lives & properties.

본 연구의 목적은 6·25전쟁 중 미군들에 의해 발생한 사건(작전)이었지만 피난민 구호에 대해서는 상반된 모습을 보여준 노근리사건과 흥남철수작전간 피난민 보호활동에 대해 인권보호, 군사작전, 국제법적인 측면을 분석하여 교훈을 도출하는데 있다. 노근리사건은 6·25전쟁 초기 수세적인 상황하에서 북한군의 강요에 의해 철수 중이던 미군이 충북 영동군 노근리지역 철길과 쌍굴 주변에서 공중 공격과 지상 사격으로 많은 피난민을 살상한 사건을 말하고, 흥남철수작전은 중공군의 6·25전쟁 개입으로 연합군이 수세로 전환된 상황하에서 장병과 함께 흥남으로 몰려든 약 10만 명의 피난민들을 선박편으로 남쪽으로 철수시킨 세계 역사상 최대 규모의 해상 철수작전이라고 할 수 있다. 노근리사건과 흥남철수작전 두 가지 사례에서 피난민 보호활동이 우리에게 주는 역사적 교훈은 첫째, 인권보호 측면에서 인류의 보편적 가치인 생명의 소중함을 알고 군사작전시에도 민간인의 생명과 인권을 보호하기 위한 군 지휘관의 노력이 필요하다는 점이다. 둘째, 군사작전 측면에서 피난민 통제대책, 피난민 속의 간첩색출활동과 피아식별대책 등이 수립되어야 하고, 유사시 대량 탈북사태에 대한 대비책도 강구되어야 함을 시사하고 있다. 셋째, 국제법적인 측면에서 민간인 학살 등의 전쟁범죄는 예방되어야 하고 사후조치를 통해 전시 민간인 보호활동은 강화되어야 한다는 것이다. 두 사례는 국민의 생명과 재산을 보호한다는 군의 존재 목적과 생명의 소중함, 인권보호에 대한 장병 교육이 필요하며, 특히 해외파병시 현지 문화에 대한 이해와 언어 소통의 중요성, 민간인 보호를 위한 교육이 강화되어야 함을 시사하고 있다.
