The Problems and Subjects of Resignation in Labor Law Lee, John According to the present labor law, it has set in detail about cancellation the labor contract depended on an employer(so-called dismissal). However, it has not set about cancellation of the labor contract by an employee. Therefore, when an employer tell an employer that he resign from a company, whether this is in charge of resignation or it is in charge of the application of agreement cancellation pose a problem. It becomes a problem especially when an employee indicate their intention of resignation in response to the some kinds of harassments from an employer. In the above-mentioned case, if it is understood as the application of agreement cancellation by an employee, it could be withdrawn until an employer consents to the application. However, when understanding the application by laborers as resignation, withdrawing in principle is impossible. In this paper, I'd like to research about legal examination of resignation based on the above awareness of the issues. And I want to aim at exploring solution about the problem involving resignation.
