The standpoint about legal nature of N-screen service can be classified roughly into two types, that is broadcasting or internet content service. N-screen service that is provided the broadcasting program by internet protocols maintains the nature of broadcasting. The merit of this stance is to apply broadcasting ideas such as the protection of viewers right to N-screen service. From viewers’ standpoint, it is difficult to legitimate that the different regulation applied to the same broadcasting programs, in spite of N-screen service and that viewers are placed in poor standing without the protection of viewers right system. According to this approach, the frame of broadcasting licensee have to hold to N-screen service for maintaining broadcasting ideas. But it is efficient that the level of entry regulation is to degree of value added common carrier, because to overburden for business is not proper. For applying broadcasting ideas, it needs to maintain universal access right, media diversity regulation and the frame of pay broadcasting regulation, But it is difficult for area regulation to apply to N-screen service. In content regulation, it needs to maintain the broadcasting program rating system and self-screening and have to be introduced additionally age validation for harmful media to youth. To the standpoint of the nature of N-screen service is broadcasting, it is the practical legislation plan that the first step is promoting ahead a special law, the second step is to integrate the Broadcasting Act. The special law plan are generally to amend the Internet Multimedia Broadcasting Business Act or newly to enact the special law for N-screen service.

N-스크린 서비스의 법적 성격을 보는 시각은 방송으로 볼 것인가 아니면 인터넷콘텐츠 제공서비스로 볼 것인가로 대별될 수 있다. N-스크린 서비스라는 것이 방송프로그램이 인터넷으로 서비스된다는 측면에서 보면 방송의 성격을 유지하고 있다고 볼 수 있다. 방송의 성격이 유지된다고 보는 관점의 장점은 시청자 권익보호를 비롯한 방송이념을 적용할 수 있다는 점이다. 시청자의 입장에서 보면 N-스크린 서비스라 할지라도 같은 방송프로그램에 대해서 전혀 다른 규제가 적용되고 특히 시청자 권익보호 장치가 없는 열악한 지위에 놓일 수 있다는 것이 정당화되기 어렵다. 이러한 접근에 따르면 방송이념의 유지를 위해서 방송사업자의 틀이 N-스크린 서비스에서도 유지되어야 한다. 다만 진입규제의 측면에서는 사업자에게 지나친 부담은 적절하지 않으므로 부가통신사업자 정도의 진입규제면 족할 것이다. 그럼에도 방송이념이 적용되어야 한다는 측면에서는 보편적 시청권, 미디어다양성 규제, 유료방송 규제프레임은 N-스크린 서비스에서도 원칙적으로 유지될 필요가 있다. 그러나 권역규제는 N-스크린 서비스에 적용되기 어려울 것이다. 내용규제에는 방송프로그램 등급제와 자체심의는 유지할 필요가 있고 청소년유해매체에 대한 연령확인 방식이 추가로 도입되어야 한다. N-스크린 서비스를 방송으로 규정한다고 할 때 먼저 생각할 수 있는 입법방식은 제1단계로 특별법을 추진하고 그 다음 단계로서 통합방송법으로 가는 것이 현실적인 방안일 것이다. 특별법 방안으로는 인터넷 멀티미디어방송사업법을 전부 개정하는 것과 독자적인 특별법을 제정하는 것을 생각해 볼 수 있다.
