The purpose of this study is to investigate the effectiveness of regulatory reform on property price control in achieving economic efficiency and dynamics, and to develop market environment where everyone can compete for better performance, an ultimately aim of regulatory reform.
I have analyzed the structure, characteristics, and the present state of price control on housing market. The results show that the regulation of the new apartment price consisting of public disclosure of construction and price ceiling for new apartment has been neither appropriate nor effective. Under the circumstance where new apartment is sold before construction, the price of new apartment does not reflect a market value, but rather a presumed value. As it is based on presumed value, which is not a clear cut concept, it is not legally clear to punish a person violating the price ceiling regulation. In addition, price control tends to infringe on fundamental human right guaranteed by the constitution.
As an ideal regulatory reform for the price control system, I recommend the deregulation of anti-market policies such as price regulation of new apartments. In the mean time, market’s self-regulation should be strengthened. However, we should be aware that market brings us only economic efficiency. As such, I suggest a governance model, which is a co-regulation by the market and the government, aiming for both efficiency and equity.
