Many countries and organizations feel uncertain about various issues emerging as a result of the new, rapidly developing technology and they are questioning the suitability of the e-commerce, physically based legal system for the regulation of cyberspace, which is practically borderless.
UNCITRAL(United Nations Commission on International Trade Law) best represent international rules when it regulate the e-commerce.
The Working Group of UNCITRAL began its deliberations on electronic contracting at its thirty-ninth session (New York, 11-15 March 2002). The deliberations of the Working Group since that time are summarized in the provisional agenda for its forty-fourth session.
The “Draft Convention on the use of electronic communications in international contracts” presently contain the newly revised version of the draft convention, which reflects the deliberations and decisions of the Working Group at its previous sessions.
Korean government also prepared revision to basic law on electronic transaction, and have 6 months to enforce it. Therefore, the purpose of the study will compare the common theme and the differences between Draft convention on the use of electronic communications in international contract and Korean Basic Law on Electronic Transaction
