The purpose of this paper is to analyze the period of responsibility covered by ocean carrier and cargo insurer in the Hamburg Rules and Constitute Cargo Clauses(1983).
Article 4 of the Hamburg Rules deals with the "period of responsibility". This article governs the duration of the carrier's responsibility which is extended to the entire period during which the goods are in the carrier's charge, at the port of loading, during the carriage and at the port of discharge, and accordingly greatly increases the liability of the carrier. Under this convention the carrier is deemed to be in charge of the goods from the time that he has taken them over from the shipper or other third party who is handling the goods for shipment. And the period of the carrier's responsibility continues until he has delivered the goods by either handing them over to the consignee at the port of discharge or transferring them to an authority or other third party to whom the goods must be handed over.
On the other hand, nowadays, cargo is usually insured under the Institute Cargo Clauses incorporating a Transit Clause on 'warehouse to warehouse' conditions. The Transit Clause states that the insurance attaches from the time of leaving the warehouse or place of storage at the place named in the policy for the commencement of the transit, the insurance continues during the ordinary course of transit, and the insurance terminates at the time of arrival in the final warehouse.
