An Empirical Study on the System and Real Condition of the ICC International Court of Arbitration and the Korean Commercial Arbitration Board
An Arbitration institution is one of the major component of arbitration system. Nowadays the institutions offering to administer arbitration procedures are increasing. The ICC International Court of Arbitration is the world's foremost arbitration institution and widely used for international commercial dispute resolution. Although the Korean Commercial Arbitration Board as a permanent arbitration institution deals with international commercial disputes, but it's not widely used in the world. While the ICC Court is truly international, the KCAB is not international. Accordingly, after studying on the background of foundation, organization, activities and arbitration procedure of the ICC Court and the KCAB, I propose some improvements of the KCAB for it's vitality and internationalization.
Firstly, the KCAB just like the ICC Court must enhance it's international reliability and status. Secondly, the KCAB just like the ICC Court must develop variable ADR system. Especially the KCAB needs to enact it's conciliation rule. Thirdly, just like the ICC Court the KCAB should allow the quality control mechanism which supervises the smooth running of each arbitration procedure and scrutinizes the arbitrator's award. Fourthly, the KCAB must join actively the international events for international commercial arbitration such as ICCA Conference and APEC ADR Meeting.
