This study aims to investigate Habermas's Theory of Juridification in modem welfare state. Habermas' theory of modem society is very comprehensive and complex. I focus on his thought of crisis of welfare state and transformation of law. As a background of problems of juridification, surveys on the crisis of welfare state and pathological consequences of law and social welfare policy are essential. Juridification is criticized in view of legal reification and evaluated as medium of internal colonization by Habermas. Theoretical relation between juridification and internal colonization is very useful insights in elucidating negative phenomenon of welfare state.
Habermas classifies types of modem states in terms of juridification. Analysis of various effects of juridification in welfare state is his main intention. Paradoxical character of juridification is expressed in ambivalent relation between freedom-guaranteeing function and taking freedom away function.
Therefore why law aiming to protect tight and guard freedom is transformed into opposite phenomenon occupies main contents of this study.
In conclusion this study examines alternative theory and policy which helping to solve problems of juridification.
