Recently our economic activities has a lot of cases depending on electronic information. Therefore the written negotiable instruments are being changed into digitalized instruments called the Electronic Promissory Note. According to these changes, the National Assembly of Korea passed the Electronic Promissory Note Act. This act is enforced at present in Korea and is the first time in the world anything like this had been passed.
However hot arguments continue about it's usefulness including legal issues with the Electronic Promissory Note.
This thesis examines three points about legal issues with the Electronic Promissory Note Act. Firstly, to create the Electronic Promissory Note, the maker has to register the creation of the electronic promissory note to a central management organization. But there's no rule about the registering of endorsement or guarantee of note. Second, even though Electronic Promissory Note can easily be transferred in electronic ways such as Internet and certificate, there are many risks such as hacking, forgery and dual transfer. Therefore operating organizations have the responsibility for operating the electronic system's safety and protecting users. Third, the users of Electronic Promissory Note are not expert on technical issues, therefore, they have to be considered to have bona fide intentions and the operating organizations has the responsibility to provide whether a user was actually involved in any wrongdoing.
To solve the above problems, this paper suggests some legal alternatives to protect electronic promissory note parties and to facilitate an operation of the Act.
