Today, biotechnology is recognized as an important industry in the economic developments of nations. States, on the one hand, are endeavoring to encourage the technical development of biotechnology, and on the other hand, they wish to maintain monopolistic control by the prevention of access to their biological resources. Responding to the trends, the international community concluded the Convention on Biological Diversity and the Cartagena Protocol on Biosafety to the Convention on Biological Diversity; each state has already legislated or is preparing to legislate to accomodate these interest. There is congruency between the developed and developing countries on the issue of the extent and method of regulation of genetic resources. The developed countries want free access to the genetic resources that are predominantly situated in tropical developing countries; developed countries regard these genetic resources as the common heritage of mankind. On the other hand, developing the countries claim their permanent sovereignty on the genetic resources of their land and ask for their share in the benefits arising from the commercialization of genetic resources. To address these competing interests, international organizations including UNEP, FAO and WIPO have been actively holding international meetings to discuss and established various working groups and panels.
This article analyzes the recent developments in the discussion on access and benefit-sharing of genetic resources in UNEP. The UNEP established an expert panel and two working groups to respond to the issue of access and benefit-sharing of genetic resources. The Draft Bonn Guideline provides standards and agreements on important issues such as the responsibilities of users and providers of genetic resources, prior informed consent procedures, dispute settlements and remedies, and so on. Although the Bonn Guideline is the most important document arising out of these discussions, there remains problems and limitations to be addressed.
