The purpose of this paper is to analyze security implications of the US North Korean Human Rights Act which came into effect in December 2004. In analyzing security implications of the Act on the Korean peninsula, this paper employs push factor and pull factor analysis which is often used to explain human migratory patterns across nations. It is assumed that if the North Korean Human Rights Act contains strategic elements that strengthen both pull and push factors rapidly promoting exits of a large number of North Koreans from the country, the effective implementation of the Act would greatly threaten the stability of the Korean peninsula, let alone North Korea. This paper found that the North Korean Human Rights Act was indeed structured to strengthen both push and pull factors, and also encouraging intermediary factors that connect push and pull factors. Therefore, if effectively implemented, the North Korean Human Rights Act will pose great threats to the North Korean regime. However, due to the reluctance of neighboring countries to cooperate with the US, and also due to the internal homeland security problems of the US, the Act is yet to be implemented in its full scale.
