There are no other different opinions about that the event named五大臣出洋 (Five Minister's Travel to the Western) was the beginning of 立憲運動(movement for requiring establishment of a constitution) in 淸末新政 (in the late Ch’ing term). This thesis is focused on what 五大臣出洋 affected the acceptance of doctrine of constitutional monarchy in Ch’ing dynasty. And also, this paper shows the new monarchial system through 豫備立憲(establishment of a constitution preparation). Especially this thesis approaches this theme centering a high ranking official 端方(Dan Bang) who has been studied relatively less. 端方was a main character among 出洋五大臣 (five minister who traveled to the Western), high ranking official who took an important role in the process of establishment of a constitution preparation. He was also a person who argued doctrine of constitutional monarchy among politicians from Manchu tribe.
First, We considered 端方 centered course of five ministers’ traveling to Europe and Americaand understanding of the Western politic system, next, it watched doctrine of constitutional monarchy affection to the establishment of a constitution preparation and process of renovation of government organization failure. 端方(Dan Bang) introduced various countries’ constitutional law through memorial to the throne, and suggested renovation of government organization, insisting government constitutionalize. As he was always able to meet 西太后(Empress of the West of the Ch’ing dynasty), It is certain that he had considerable power to establish constitution preparation.
端方(Dan-Bang)’s doctrine of constitutional monarchy went forward from monarchy to constitutional government based on that an establishment of constitution political structure is superior to a arbitrary rule political structure. And 端方’s doctrine featured limitation of monarch’s authority protection of subjects’ rights. He thought constitution government should be based on the establishment of constitution preparation. He believed that China need to take merit equally in the process of establishment of constitution preparation. In spite of this flexible recognition, there was not enough consideration about an ideological, social and economical basis that can make possible constitutional government operation.
He had understood constitutional government system from angle of monarch’s safety and the wealth and power of nation. The view was that a responsible Cabinet was for monarch’s safety and the nation assembly judicature local autonomous is a system for safety of nation showed us. In his opinion, neither main task of congress is legislation, cabinet nor is the high ranking executive agency, however, he expected to constitutionalism system to become a buffing role instead of monarch. A little pure and simple thinking that open nation assembly and execute constitutional monarchy could make China powerful and wealthy might reflected urgent situation at that time.
端方 thought that the monarch didn’t carry out his responsibility because of his sanctity. However, it was beyond to understand the origin of the monarch’s sanctity. The conception of minister including 端方 which could prevent the renovation by establishing the law seems that there was lack of understanding the nationalism. The emotion of Han race had alreadypreoccupied in many people due to the hatred, which is a minority race to a Manchurian. At that time, the Manchurian’s nationalism was overflowed to correspond it. There was an important variable, which is a full of Han’s problems to the background’s fail of reforming of the government organization. At last, the dismissal and death of 端方were the symbol to imply the end of the establishment of a constitution movement beyond the unhappiness of an individual.
