As Internet is utilized during the process of administrative works to distribute public information, it is becoming an extremely useful tool in improving the existing, inefficient process of handling administrative work. Recently, the Industrial Property Office and the Computer Program Examination and Coordination Committee began to make every effort to computerize the hitherto underdeveloped program registration and patent administration to prepare for the knowledge-information society.
The patent-net has enabled one to apply for various types of certificates and receive them through on-line system. Through such system, civil petitioners can view certificates and patent information extremely fast at cheap price without having to visit the Industrial Property Office, and even the patent-related government employees can now save efforts and time required to search, file, copy or disclose paper documents.
On the other hand, an electronic application system has been introduced, and by delivering documents through the electronic system to those registered as the applicant for the receipt of documents through on-line system, government employees can save delivery burdens (reduced by 80%), document forwarding expenses and the expenses of the civil petitioners resulting from the delayed delivery service. The computerized patent administration, in particular, has saliently improved the process of patent examination.
Compared with the open on-line system operated by Seoul City, the opening of the internal processing of patent affairs is insufficient in the case of Patent-net. Applications for examination and the results of examination are announced through Internet; however, the process of internal examinations carried out by examiners at the Industrial Property Office is not disclosed. As the promptness in the processing of patent affairs is being stressed, there are increasing cases where the patent or registration that might infringe the copyright of the 3<SUP>rd</SUP> interested parties are erroneously granted. Considering such reality, it seems desirable to examine whether it will be a good idea go disclose important points of argument through on-line system during a specific stage prior to making decision on patent or registration so that the 3<SUP>rd</SUP> parties carrying potential interest can check the related situation.
The electronic application system was completed later than Japan; however, such system may be appraised as having greatly contributed to the improvement of the speed in the examination work and to the reductions of commissions thanks to superiority. We can say that the electronic application system has contributed to the patent administration at a level similar to the open on-line system run by Seoul City.
On the other hand, the program registration service merely enter the details of registration into a database and disclose the registered information through the official program bulletin, Internet and PC networks, and even though the computer memory and the openness of Internet are being utilized to a certain degree, it is still expenses lacking. In other words, as the on-line registration system has not been introduced yet covering the program registration, it is urgent to reduce paper document by computerizing program registration work and improve convenience of the program registration.
The reason is that first, compared with the Industrial Property Office, the size of the manpower and the organization of the Program Examination and Coordination Committee is extremely small, and as the government office responsible for the program registration work changes frequently, the related office lacked capability to implement consistent and bold reform. Second, as the program registration work was entrusted to this Committee only as late as July 2001, the Committee did not have sufficient time to implement computerization.
Third, anther reason may be that the applicants for program registration are reluctant to submit program copies through electronic system considering the risk that the program information may be exposed due to the easiness of copying the program. Considering this point, it might be necessary to introduce a more security-oriented electronic system to the program registration work. The patent-net systems operated by the Industrial Property Office, an agency controlled by the Ministry of Commerce, Industry and Energy, are also being exported. In order to expedite the computer program registration service having been lagging behind for a long period of time, it is believed necessary that the Ministry of Information and Communications operating the Program Examination and Coordination Committee under its control provide active support.
