This article deals with American Local Governmental Law, focusing on the general aspects of institutions and theories. ⑴ Traditionally, units of local government in the United States has been divided into municipal corporations and public quasi-corporations. But it is important to distinguish between home-rule cities, that is local self-governments with the city charter, and non-horne-rule cities in these days. ⑵ There are today many variations in the distribution of power within city government. However, three main types of city government can be identified: the mayor-council form; the commission form; and the city manager form. These variations has contributed to the splendid development of local government law in the United States. ⑶ Formerly, the doctrine of inherent home rule, that considers home rule as inherent or natural, had been accepted by courts in several states, but has been generally rejected in recent years in the United States. The city charter is the source of municipal power. There is a famous rule of interpretation known as Dillon’s Rule that has traditionally been applied, to determine the total scope of power of local governments. ⑷ Most municipal enactments takes form of ordinances. One important requirement for enactments is that city council meetings should be open to the public, imposed by Sunshine Laws, that is open-meeting laws. Under constitutional or legislative home rule, state legislative acts must yield to local laws when those acts deal with basically local concerns and are in conflict with laws of the municipality. Anyway, this study in the comparative method will be expected to be useful in interpreting and possible revision of Korean Local Government Statute.
