EU established New Regulation Systems (NRF) for electronic communications market in 2002. According to NRF, national regulatory authorities have general competence for resolving conflicts arising between parties on electronics communications market. These authorities are specialized in the treatment of difficulties relating to electronic communications. Pursuant to 2002 Framework Directive, cases brought before national regulatory authorities be resolved with the adoption of a binding decision. But national regulatory authorities may attempt to resolve conflicts through non-conventional mechanisms if Member States allow it.
The NRF further provides that undertakings and individuals may seek redress from national courts. Applicants are not prevented from seeking a remedy in court as a result of request being addressed to an national regulatory authority. In some cases national courts and national regulatory authorities are equally competent to handle cases. Little co-ordinations is provided for in the NRF to resolve concurrent jurisdiction issue between national courts and national regulatory authorities in electronic communications market. It is to be hoped that guidelines will be provided at European level.
Parallel to the rules composing the NRF, undertakings and users alike can act on the basis of the competitions rules where these have been infringed. In pursuance of 1/2003 Regulation, the Member States must designate the authorities which are responsible for the application of European competitions rules on their respective territories. National competition authorities are empowered to adopt decisions requiring that an infringement be brought to an end, ordering interim measures and imposing fines or penalties. Ultimately, the organizational structure established in Regulation 1/2003 ensure that the application of European competitions rules remains the prime responsibility of the European Commission. In that organization, the national authorities act as decentralized organs. The implication is that national competition authorities are indeed subject to the authority of Commission in the fulfillment of tasks.
