The Privatization and following liberalization of communications market in progress gives birth to the new demand for the competition regulation. In communications market where the long history of national monopoly, there needs to be special kind of competition regulation: unsymmetrical ex ante regulation on (usually) Incumbents. In Korea unsymmetrical obligations under ex ante regulation fall on the Incumbents based on the sales of the precedent business year and market share. These are comparatively simply applicable standard, but not elaborate and flexible standard enough to response to the liberalized market and fast-changing communication technology and the resulting convergence of communications and media.
The alternative regulatory system is the unsymmetrical ex-ante regulation based on the market analysis and the decision of Significant Market Power(‘SMP’). EU communication regulation system under the Framework Directive(2002/21/EU) is a strong model of it. Under the strong model, a sectoral regulatory agency shall impose special conditions on the incumbent only when there is recognized that the incumbent has the SMP in the specific market from the market analysis. It also fits into the communication convergence because it can decide the regulation target in a flexible way through the market definition procedure.
But such a strong model seems to be harmonized with other elements of regulatory system. It matches with the more liberalized market, the more weight on the competition regulation rather than the other sectoral regulation, the independent regulatory agency with economic expertise, and the broad and substantial consultation process. On 3. Jan. 2007, the Electronic Communications Industry Act newly introduced the “market competition analysis” for the competition policy planning. At present it does not function as a trigger for the ex-ante regulation. It is a natural regulatory combination when considering the degree of liberalization of communications market. But the introduction of “market competition analysis” shows the intent of the sectoral regulatory agency to develop the new regulatory system based on the result of market competition analysis.
