“Administrative entity (haengjeong-juche)” is a basic concept widely used in administrative law. It is indispensable not only to understand who performs the duty of public administration but also to establish the concept of public administration itself and, under the dual system of public and private law, to set up a standard to distinguish the objects of administrative litigation from those of civil litigation. Thus understanding what an administrative body is and what are comprised therein is very important both to administrative jurisprudence and practice.
An administrative entity is a public entity which possesses administrative power in its own name, exercises it through its organs and to which the rights and duties arising from exercise of administrative power belongs. Administrative entities are classified into the state and other public bodies. Among them, the term "public body (gonggong-danche)" is generally used to include local governments and other incorporated public bodies, such as public associations (gonggong-johap), public corporations(yeongjomul-beobin) and public foundations (gong-jaedan). Such conceptualization, however, has some logical defects and practical problems. First, it is inappropriate to put into a single category local governments with comprehensive administrative power and other public bodies which have only specific, restricted power. Moreover, some of the bodies designated as public bodies are not suitable to called so.
What is far more important is that some of the public bodies, especially those called public associations, cast some doubt concerning the concept and nature of administrative entities. What is the difference between such professional organizations as Bar Associations and Medical Associations designated as public associations on the one hand and occupational or trade organizations which are considered just as private associations on the other hand? What are their characteristics that make them to be called public bodies?
This article calls for more thoughtful examination into these questions and suggests that the title of administrative entity or public body should be given only to those bodies that are invested with the function of performing public interest as their duty.
