The present paper purports to lay down a preliminary assessment on the role of the judiciary in the 'war against terrorism' since the attacks of September 11, 2001 in particular. In constitutional perspective growing concerns have been expressed over the sweeping breadth of the executive's assertion based on the national security as it relates to the protection of civil rights, especially of foreigners residing in the United States.
Despite constitutionally anchored notions of 'due process' and 'equal protection' guaranteeing the protection of civil liberties and other rights, faced with the terrorist acts which the Administration views legal equivalent of belligerent acts, one is not deemed to enjoy those rights as before. President Bush went on even further by postulating a new concept : "We are protected from attack only by vigorous action abroad, and increased vigilance at home." America thus declared War on Terrorism.
A war scenario gives the President , as commander-in-chief, an extensive room for maneuver. Various measures based on the "Need for Proactive Protection" have been taken by the executive. In this context, fundamental constitutional principles regarding the contest between 'national security' and 'civil liberties' came to be reassessed within the constraints of the laws of war.
Three landmark cases, Rasul, Hamdi, and Padilla, arose recently in the aftermath of September 11. Departing from its traditional deferential approach, the Supreme Court emphatically rejected the government's contention that it could detain indefinitely anyone it designated as an 'enemy combatant' in the war against terrorism. These and others are dealt with in the paper with a view to putting forward a preliminary assessment on the evolving constitutional law relating to the 'war on terrorism'.
