If we remind the shameful fact that South Korea had been long labelled as a nation of labor repression, the enactment of National Human Rights Commission Law in April 2001 is really monumental. Undoubtedly, it will lay a basis for the protection of human rights in both political and industrial arenas where violation of human rights frequently occurred under the authoritarian rules. It is hardly denied that democratization since 1987 has significantly contributed to the improvement of human rights as compared to the authoritarian period. However, there are still numerous tasks to accomplish them as is performed in advanced democracies. It is noticeable that disappointment of industrial workers gradually incleased as the labor-friendly Kim Dae-Jung government finally succumbed to the neoliberal pressure in the process of managing the foreign debt crisis that frustrated President Kim's political belief to fully improve legal and institutional environments for human rights. While the effort of Kim government bas been crucial for the progress of political right of industrial workers, social and economc rights are still backward by the wake of globalization disturbing positive effects of democratization. This paper lays a focus on the accomplishment and limt of Kim government in advancing legal and institutional environments for industrial rights, bringing it to the analysis the counterveiling effects of democratization and globalization on human rights. It stresses the danger of reemergence of the liberty trade-off ideology in the wake of globalization especially in industrial arena in favor of flexibility and competitiveness.
