With the outbreak of cybercrime, the response policy for cybercriminals continues to increase. On the other hand, efforts to protect and support victims of cybercrime are relatively insufficient. As such, since interest in cybercrime is quite inclined toward criminals, it is necessary to shift the interest toward victims of cybercrime. Therefore, in this paper, we looked at ways to protect crime victims in cyberspace. Since the types of damage in cyberspace are very diverse, we have reviewed cyber violence, cyber sex crimes, and cyber fraud, which continue to calculate crime damage statistics in Korea. As a result, first, in the case of cyber violence, it is necessary to introduce a practical prevention program method. In addition, the reporting rate of victims of cyber violence should be increased, and the credibility of investigative agencies' response to cyber violence should be increased. In addition, cyber violence response policies are mainly centered on adolescents, and policies covering adults should be prepared. Second, in the case of cyber sex crimes, the legal basis for protecting crime victims is relatively sufficient. However, in practice, the law does not seem to be applied properly. In particular, efforts should be made to prevent secondary damage by investigative agencies. In addition, the cyber sex crime support center should be expanded and budgeted so that it can actually operate. In addition, it is necessary to be able to effectively respond to cyber sex crimes committed on the basis of overseas by joining international agreements. Third, in the case of cyber fraud, more efforts should be made to confiscate the perpetrator's criminal proceeds and compensate the victim for the loss. To that end, efforts should be made to expand the payment suspension system and actively recover the criminal proceeds of cyber fraudsters. And the profits recovered should be refunded to the victim as soon as possible. Victims of cybercrime are occurring at this time as well. However, in reality, more attention is focused on criminals than victims of cybercrime. There is no sanctuary for cybercrime damage. Anyone can be a victim of cybercrime. In order to protect victims of cybercrime, it is not just a formal enactment of laws, but a little more effort should be made to ensure that the laws can actually protect crime damage in the field.

사이버범죄가 창궐하면서 사이버범죄자에 대한 대응정책과 관련 연구들은 계속해서 증가하고 있다. 그에 반해 사이버범죄 피해자를 보호하고 지원하기 위한 노력은 상대적으로 더딘 행보를 보인다. 이처럼 사이버범죄에 대한 관점이 범죄자 쪽으로 상당히 기울어져 있으므로 사이버범죄 피해자를 보호하고 지원하기 위한 관점으로 평행 추를 이동시킬 필요성이 있다. 그러므로 본 논문에서는 사이버공간에서의 범죄피해자를 보호하기 위한 방안에 대해 살펴보았다. 다만, 사이버공간에서의 피해 유형이 매우 다양하므로 한국에서 지속해서 범죄 피해통계를 산출하고 있는 범죄유형인 사이버폭력, 사이버성범죄, 사이버사기를 중심으로 살펴보았다. 그 결과 첫째로, 사이버폭력의 경우 형식적 예방 교육이 아닌 실질적이고 프로그램 방식의 예방 교육으로 전환할 필요성이 있다. 또한 사이버폭력 피해자의 신고율을 높여 사이버폭력이 암수범죄로 되는 것을 방지해야 한다. 사이버폭력은 주로 아동·청소년을 중점으로 대응하고 있는데, 성인을 포함하는 포괄적인 정책이 마련되어야 할 것이다. 또한 사이버성범죄와 같이 사이버폭력 처벌 규정 및 피해자 보호 규정을 마련할 필요성이 있다. 둘째로, 사이버성범죄의 경우 범죄피해자 보호를 위한 법률적 근거는 상대적으로 충분하다고 할 수 있다. 사이버성범죄를 처벌하기 위한 다양한 처벌 규정들이 마련되어 있으며, 개별법을 통해 사이버성범죄 피해자를 위한 다양한 보호장치들도 마련되어 있다. 이제는 그런 형식적 장치들이 실질화되도록 노력해야 한다. 그를 위해 수사기관 및 사법부의 사이버성범죄 인식 개선 노력과 사이버성범죄 피해자 친화적인 수사 관행이 자리를 잡아야 할 것이다. 또한 사이버성범죄 지원센터가 형식적으로 운영되지 않도록 인력확충과 예산충원이 요구된다. 그리고 유럽 사이버범죄 방지협약과 같은 국제협약에 가입하여 해외를 근거로 한 사이버성범죄에 보다 효과적으로 대응할 수 있어야 할 것이다. 셋째로, 사이버사기의 경우 그 피해가 막대하지만, 여전히 피해자 보호에는 미흡한 부분이 많다. 그에 대한 해결 방안으로 제한적으로 운영되고 있는 지급정지 제도를 개선하고, 사이버사기범의 이익을 몰수 및 범죄이익을 환수하는 것을 좀 더 적극적으로 활용할 필요성이 있다. 그리고 그렇게 환수한 이익이 피해자에게 가능한 한 빨리 환급될 수 있도록 조금 더 적극적인 대응이 필요하다. 그를 위해 독립몰수제와 같은 제도가 도입될 필요성이 있다. 사이버범죄 피해자는 시공간을 넘어 지금도 발생하고 있다. 하지만 현실은 사이버범죄 피해자보다 범죄자에게 좀 더 관심이 집중되고 있다. 사이버범죄 피해의 성역은 없다. 누구나 사이버범죄 피해자가 될 수 있다. 그러므로 이제는 사이버범죄 피해자를 보호하기 위한 관점으로 평형추를 옮겨야 한다. 그리고 범죄피해자 보호를 위해 형식적으로 법률만 제정하는 것에 그치는 것이 아니라 해당 법률에 따라 현장에서 실질적인 범죄피해자 보호가 이루어질 수 있도록 더욱 노력해야 할 것이다.
