“세계헌법의 제정에 관한 고찰”이라는 본 연구는 현재 세계적으로 확산 발전되고 있는 세계적 입헌주의(Global Constitutionalism)를 더욱 발전시켜, 세계평화와 인류의 안전과 행복을 확보하기 위해, 세계헌법을 시급히 제정해야 하겠다는 세계적 시대적 과제에 대한 해결책을 찾기 위한 것이다. 이 세계헌법 제정 문제는 매우 광범위하고 복잡하고 난해한 면이 많이 있어 상당히 생소한 주제라고 생각될 수도 있을 것이다. 따라서 육하원칙(六何原則)에 의거하여, 1)누가 세계헌법을 제정한다는 것인가? 즉, 세계헌법제정의 주체인 세계헌법제정권자와 세계 공동체의 주권자는 누구인가 하는 문제, 2)언제 세계헌법을 제정한다는 것인가? 하는 세계헌법제정의 시기 문제, 3)어디서 세계헌법을 제정한다는 것인가? 하는 세계헌법제정의 장소 문제, 4)무엇을 제정한다는 것인가? 하는 세계헌법의 내용 문제, 5)어떻게 세계헌법을 제정한다는 것인가? 하는 세계헌법제정의 방법 문제, 6)왜 세계헌법을 제정해야 하는가? 하는 세계헌법제정의 이유와 근거 및 필요성 문제에 대하여 고찰하였다. 본고는 이러한 세계헌법 제정 문제가 인간의 존엄성과 인권 및 세계평화와 세계 모든 사람의 안전과 행복을 실현하기 위한 인류의 염원을 현실화하려는 세계 인류, 세계인의 현재의 대장정이라고 할 수 있다는 문제의식을 견지하였다. 이상의 제 점에 비추어, 본 연구에서는 먼저 세계적 입헌주의와 세계헌법 제정의 의의를 알아보고, 이어서 세계헌법제정의 근거와 필요성에 관하여 먼저 세계헌법 제정의 세계 현실적 이유와 필요성을 알아본 후, 세계헌법 제정의 헌법적, 헌법철학적 근거와 필요성을 고찰하였다. 세계헌법 제정의 헌법적 근거와 필요성을 밝히기 위해서는, 먼저 세계헌법 제정 문제가 막연한 유토피아성만을 갖는 것이 아니라는 세계적인 수많은 헌법학자의 긍정적 이론적 근거를 제시하고, 세계적 입헌주의와 세계헌법 제정의 필요성을 인정하는 세계 헌법학계의 긍정적 동향을 고찰하였다. 다음으로는 이상의 긍정적 근거를 심층적으로 뒷받침하기 위하여, 세계헌법 제정의 헌법 철학적 근거와 필요성을 고찰하였다. 먼저 세계헌법 제정의 근거가 되는, 세계 인류 모두가 하나이고 단일하고 동일하다는 것을 헌법 철학적으로 밝히기 위하여, 인간의 존엄성의 헌법 철학적 본질 문제를 검토하고, 이를 활용하여 인간의 존엄성이 가지고 있는 자연법으로서의 진리의 속성을 고찰하였다. 또한 세계헌법 제정의 헌법 이론적 근거가 되는 세계적 사회계약과 세계적 일반의사의 헌법 철학적 본질을 밝히기 위하여, 사회계약 이론상의 “전면양도”와 “일반의사”의 의의와 본질을 존재철학 원리를 활용하여 헌법철학적인 심층적 고찰을 하였다. 사회계약 이론에 의하면 “일반의사”는 항상 올바른 의사를 의미한다는 점에서, 인간의 존엄성과 자연법으로서의 진리와 같다는 점을 헌법철학적으로 고찰하였다. 무형적인 자연법적 진리로서의 인간의 존엄성은 세계 인류 모두에게 공통적이라는 세계적 보편성이 세계헌법 제정의 근거가 되므로, 이 근거를 헌법철학적으로 더욱 명확히 밝히기 위하여 “헌법존재론 도해”(“세발자전거” 도해)라는 헌법존재론 도해를 활용하여 “무형적”인 자연법으로서의 인간의 존엄성을 가상적으로 “유형화”시켜 실증적으로 고찰하였다. 세계헌법제정의 주체와 방법에 관하여는, 세계헌법제정의 주체로서 첫째, 국제연합(UN)에 의한 세계헌법 제정 방법과 둘째, 세계헌법 제정을 위해 40년 이상 세계헌법안을 만들어 현재 세계적인 비준 활동을 지속적으로 전개하고 있는 세계적 시민단체인 “세계연합”에 의한 세계헌법 제정 방법을 구체적, 실증적으로 고찰하였다. 세계헌법 제정의 법적성격과 광범위성하고 다양한 내용으로는, 1)국가 간 공존질서로서의 세계헌법의 내용, 2)세계권력 제도화로서의 세계헌법의 내용, 3)최상위 세계 규범으로서의 세계헌법의 내용, 4)국가차원 입헌주의의 통합헌법으로서의 세계헌법의 내용, 5)인간의 존엄성과 인권보장 근본규범으로서의 세계헌법의 내용을 고찰하였다. 이상과 같은 세계헌법 제정의 기본적 고찰을 바탕으로 하여, 세계헌법 제정의 실현 방법론을 제시하였다. 이 세계헌법 제정의 실현 방법론을 명확하고 알기 쉽게 실증적으로 밝히기 위하여, “세계적 사회계약”과 “세계적 일반의사”에 의한 세계헌법 제정 실현방법의 본질 구조도라는 [제6 헌법존재론 도해 : 세발자전거론 : Theory of Tricycle]를 창안(創案)하여 그 내용을 헌법철학적으로 구체적으로 밝혔다. 이상과 같은 헌법의 근본원리의 내용을 일방, 모든 인류와 모든 국가에게 사회 문화적, 국가적, 세계적으로 헌법교육과 인성교육으로 잘 “교육”하면서, 타방, 인류의 지혜가 현재까지 발전시켜 온 “현대입헌주의의 5대 원칙”을 “세계적 입헌주의의 5대 원칙”으로 새롭게 더욱 발전시켜 실제로 세계헌법을 제정하는 것이, 세계 인류 전체의 미래와 희망인 세계헌법 제정을 앞당기고 실현하는 실효적이고 올바른 방법론이라는 결론을 도출하였다.

This study, entitled “A Study on Establishment of World Constitution,” urges the World Constitutionalism, which is now spreading and developed globally, to urgently enact the world constitution in order to secure world peace and human security and happiness, to find a solution to the world-wide challenges of doing that. The issue of constitutional establishment of this world constitution is very broad, complicated and difficult to understand. Therefore, in accordance with the “six-questions rule”, 1). Who constitutes the world constitution? In other words, who is the ruler of the world constitution and the sovereign of the world community who are the subjects of the world constitution enactment, and 2) When will the world constitution be enacted? The issue of the timing of the World Constitution enactment, 3). Where does the World Constitution come into effect? The issue of the place of the world constitution enactment, 4). What do you enact? Contents of the World Constitution. 5). How do you enact the world constitution? The problem of how to enact the world constitution, 6). Why Constitute the World Constitution? The reasons for the establishment of the World Constitution, the basis and necessity of the Constitution were examined. This article considers that the problem of the establishment of the World Constitution can be considered as the current major event of the world humanity and the world to realize the human dignity, human rights and world peace and the desire of humanity to realize the safety and happiness of all the people of the world. . In this study, we first examine the significance of global constitutionalism and the significance of the world constitution, and then examine the reasons and necessity of the world realization of the world constitution ; the constitutional and constitutional philosophical grounds. In order to unveil the constitutional grounds and necessities of the world constitution, it is necessary to propose a positive rationale for the constitutional scholars of the world that the issue of the world constitution does not have only a vague utopia, recognizing the necessity of world constitutionality and the establishment of the world constitution. I examined the positive trend of the world constitutional academy. Next, in order to deeply support the positive grounds above, we examined the constitutional philosophical basis and necessity of the establishment of World Constitution. First, we examine the constitutional philosophical essence of human dignity in order to unveil the constitutional philosophy that all human beings in the world, which are the basis of the world constitution enactment, are one, single, and the same. In addition, in order to clarify the philosophical essence of the “global social contract” and the constitutional philosophy of the “global general will”, which is the rationale of the establishment of the world constitution, I made a philosophically deep study on the meaning and essence of “full transfer” and “general will”. According to the social contract theory, the “general will” always refers to the right will, and it is the same as the dignity of humanity and the truth as natural law. The universality that human dignity as an intangible natural legal truth is common to all humans in the world, is the foundation of the world constitution. Therefore, in order to clarify this basis more clearly in the philosophy of the Constitution, “Constitutional ontology” using the diagrams of the ontology of the Constitution, we hypothetically “typified” the dignity of human beings as “intangible” natural laws. With regard to the subject and method of the world constitution enactment, it is necessary, firstly, to establish the world constitution by the United Nations, and, secondly, by the global citizen organization that continuously develops its activities, examines the method of enacting the world constitution in concrete and empirical way. The broad and varied content of the World Constitution enactment. 1) the content of the world constitution as a coexistence order between nations, 2). Contents of world constitution as institution of world power, 3). The contents of the World Constitution as the highest world norm, 4). The contents of the World Constitution as a unified constitution of national constitutionalism, 5). We examined the contents of the world constitution as the fundamental norm of human dignity and human rights guarantee. Based on the above - mentioned basic examination of the constitution of the world, the methodology of realizing the constitution of the world was suggested. In order to clarify the methodology of realization of the world constitution enactment clearly and easily, it is necessary to create the “Sixth Constitutional Ontological Theory : Theory of Tricycle” which is the essence structure of the “Global Social Contract” and “Global General Will”. The contents were expressed in concrete philosophy. It is necessary to “educate” the contents of the fundamental principles of the Constitution to one, all humanity and all nations in socio-cultural, national and global terms with constitutional education and humanity education, The "five principles of constitutionalism "as" the "five principles of global constitutionalism "and establishing a real world constitution is the effective and correct methodology that advances and realizes the world constitutional law enactment.
