Article 14 of ACT ON SPECIAL CASES CONCERNING THE PUNISHMENT OF SEXUAL CRIMES stipulates that person who takes photos of another person’s body, which may cause any sexual stimulus or shame against the one’s will, by using a camera or similar mechanism shall be punished. However, the court does not specify specific standards for this, and making differing ruling on a similar cases. This study conducted a decision tree analysis based on a total of 503 cases of 75 imprisonment, 308 probation, and 120 fines in order to empirically examine what kind of decision the court makes on the crime of illegal filming using cameras. It is found that determining factors in splitting the fine and probation were whether the naked shots was filmed, crime location, the number of victims, the offender and victim relationship, the number of times of filming, and whether the materials were distributed. In case of probation and imprisonment, when offender has a prior convictions for the same crime and took a picture of an individual’s unintentionally exposed naked body, the likelihood of receiving a prison sentence were high. This study investigated various factors influencing the judicial decision on the crime of illegal filming using cameras, which is relatively lacking empirical research.
