Official Information Disclosure Act has been legislated in 1996 by to ensure the people's rights to know and to secure the people's participation in state affairs and the transparency of the operation of state affairs by prescribing necessary matters concerning the people's claims for the disclosure of information kept and controlled by public institutions and the obligations of public institutions to disclose such information. Among the representative method today for raising credit and communication is the administrative information system, which must be observed and modified constantly for the correct maintenance of relation between people and government. Every people holds the right to request information disclosure. Requests for disclosing information made by any foreigners shall be prescribed by the Presidential Decree. When any applicant is dissatisfied with a decision made by any public institution in connection with information disclosure, he may file an administrative appeal under the conditions as prescribed by the Administrative Appeals Act. In that case, administrative agencies that supervise the decisions of public institutions, other than state agencies and local governments, shall be the heads of the relevant central administrative agencies or the heads of the relevant local governments. Every applicant may file an administrative appeal without going through the procedures for filing administrative appeals. Any member who is involved in administrative appeals of decisions on whether or not to disclose information from among the members of the Administrative Appeal Committee shall not divulge secrets that the member has learned while performing his duties during his tenure and after his retirement. This study analyzed the information disclosure system and evaluated the performance and problems.

공공기관의 정보공개에 관한 법률은 국정운영에 관한 국민의 알권리를 보장하고 국민의 참여를 독려하기 위하여 1996년 제정되었다. 오늘날 행정에 대한 국민의 신뢰를 제고하고 소통할 수 있는 대표적인 방법으로 바로 행정정보공개제도 들 수 있다. 정보공개법 제3조에서 공공기관에게 보유・관리하는 정보를 공개하여야 할 법률상 의무를 지우고, 제5조에서 모든 국민에게 정보공개청구권이 있음을 명시하고 있다. 그러므로 국민으로부터 보유・관리하는 정보에 대한 공개를 요구받은 공공기관으로서는 제9조 제1항 각 호에서 정하고 있는 비공개사유에 해당하지 않는 한 이를 공개하여야 할 의무가 있다. 본 논문에서는 행정심판상 행정심판상 공공정보공개 청구사건에 관해서 고찰하였다. 정보공개신청과 관련된 권리구제절차로 행정소송 이외에 우리나라 정보공개법은 이의신청과 행정심판을 규정하여 불복신청에 관하여 이원적 구조를 취하고 있다. 행정심판은 행정청의 처분과 부작위에 대한 간이・신속・저렴한 불복절차이다. 또한 심사기준에서도 위법성 뿐 아니라 부당성을 가지고도 정보공개에 관한 판단을 할 수 있다. 중앙행정심판위원회는 정보공개법에 따라 비공개사유에 대한 법적 근거나 구체적인 내용, 불복방법 및 불복절차를 구체적으로 명시해야한다고 밝혔다. 또한 청구된 정보가 존재하는 개연성이 있음에도 행정기관이 부존재한다는 이유로 공개를 거부한 것은 위법하다고 지적했다. 중앙행정심판위원회는 정보공개법 제9조 제1항에 규정된 비공개 대상정보에 관한 해석에서도 시민의 알권리를 보장하기 위한 취지의 재결을 다수 내렸다.
