This article attempts to bridge a pluralist notion of justice and the concept of equity through an investigation of the meaning of the phrase ‘fair and equitable’ found in various fields of international law. Under the premise that justice is achieved by combining law and equity, this article explores six notions of justice and the meanings, principles, and contents of equity, arguing that justice must reflect the principles and contents of equity. The aim is to determine i) whether the Nagoya Protocol pursues these notions of justice according to the characteristics of equity, and if not, ii) what kind of solution can be suggested to improve current inequity. By examining relevant articles of the Protocol, this study finds that the Protocol addresses distributive and procedural aspects of equity in a limited way and consideration of context is neglected. Given that the discussion on achievement of ‘fair and equitable’ benefit-sharing is still ongoing in various international fora, and that the Protocol shall be implemented in a mutually supportive manner with those international instruments, it is suggested that the contextual aspect of equity regarding the phrase ‘fair and equitable’ benefit-sharing be taken into account in fora and the relevant international instruments negotiations in order to pursue a multiple and balanced approach in the application of ‘fair and equitable’ sharing of benefits prescribed in the Protocol.
