Currently, even after the 2013 Supreme Court en banc ruling, controversy continues over the ordinary wage of regular bonuses and the validity of the terms of employees on the payment date. I think this issue will be concluded by clarifying whether the regular bonus is "work consideration" and whether specific bonus claims occur. We look forward to a careful and firm judgment of the Supreme Court"s en banc decision. In particular, it would be desirable to ultimately prepare and resolve detailed regulations on the requirements and scope of ordinary wages and whether (regular) bonuses are wages that can be included in ordinary wages.
In conclusion, such a problem will have to be judged as to whether the regular bonus is "remuneration for work" and "paid in the form of a fixed wage". In addition, the provision of incumbent conditions on the payment date of regular bonuses according to collective agreements, etc. will be effective as long as wages are paid for previously provided work even if individual workers retire before the payment date. In addition, it would be desirable to resolve the requirements and scope of ordinary wages, the applicability of regular bonuses to ordinary wages, and the validity of the conditions for incumbents on the payment date, etc. through legislation in the future. We expect a prudent and firm judgment from the Supreme Court"s all-colonial decision.
