This article aims to understand the conflict between the Korean government and religious communities over the infectious disease prevention and control measures(hereinafter referred to as IDPC measures) in the spread of Covid-19 and suggest possible direction to solve that problem. For this purpose, in Chapter 2, I reviewed the legal basis for IDPC measures applied to religious communities. Then, in Chapter 3, I reviewed the different reactions of religious communities to IDPC measures. Finally, in Chapter 4, I proposed the direction of the IDPC measures policy related to religious communities.
The IDPC measures are legally based on the Constitution, the Infectious Disease Control and Prevention Act, and in some cases the Assembly and Demonstration Act. In general, religious communities conform to the government policy. However, at the same time each of the communities has cooperated with IDPC measures at different levels and has shown a generally passive attitude. In addition, some of the communities, like the Protestants, have strongly rejected IDPC measures, which caused many social problems. Religious communities’ passive attitude toward and sometimes rejection of IDPC measures can be explained by the fact that religions are not recognized as the subject of IDPC measures more than any other factors. In other words, this refers to the reality in which public health authorities recognize religious communities merely as the objects of IDPC measures.
However, regarding IDPC measures, it should be emphasized that the percentage of religious people in Korea is about 50%. This suggests that they constitute a great part of the Korean society and that those communities should be considered as one of the crucial factors while enforcing the IDPC measures policy. Therefore, a new control and quarantine system, in which the government, the medical community, as well as religious communities will be treated equally as its subject, should be established. Only in that case public health authorities will be able to effectively implement IDPC measures amongst religious communities. Moreover, treated as subject of IDPC measures policy, religious communities should play a positive role not only during the pandemic, but it is believed that these experiences can contribute to protecting the health of the people even after Covid-19. It is hoped that this study will contribute to establishing the IDPC measures policy related to religions in the era of infectious diseases after Covid-19 in the future.
