In the respect that the establishment of the Korean Provisional Congress introduced a modern parliamentary system to Korea, this study examines what influence the Korean Provisional Congress had on the initial formation of the Korean parliamentary system and what constitutional meanings the Provisional Congress has.
The formation of the Korean Provisional Congress is not irrelevant to the time when Constitutionalism began to spring up in Korea in the late nineteenth century and when the western parliamentary system began to be introduced to Korea. The formation was based on theoretical and empirical understanding of the western assembly system which was presented in the Fourteen Articles of the Exemplary Rules, in the movement posed by the Independence Club to establish National Assembly, in the Royal Constitution of the Korean Empire, and in various newspapers and textbooks.
The establishment of the Korean Provisional Congress evaluated as the introduction of the modern parliamentary system has the following constitutional meanings. First, the Korean Provisional Congress had performed an actual role of National Assembly until the independence of Korea from Japan because it had and exercised the authority of today’s representative body with legislative power, financial power, power to keep the government in check, and so on.
Second, the Korean Provisional Congress was more than just a normal representative body or a normal legislative body in terms of its function and role. In other words, the Korean Provisional Congress assumed a key role as an organization which essentially created legitimacy of the Constitutional Convention or the Provisional Government. The Korean Provisional Congress itself enacted a constitution and existed as a legislative authority according to the constitution.
Third, many of the relevant provisions such as the interim constitution, Korean Provisional Congress Act, and so on will provide normative continuity with such relevant provisions as the current Constitution, National Assembly Act, National Assembly Secretariat Act and so on. This could be the source to examine the continuity from a normative dimension, getting out of the discussion that the Korean Provisional Congress went through Emergency National Assembly and National Convention, leading to today’s National Assembly.
Fourth, the system in which the government continuously took charge of the Korean Provisional Congress in the modified form of government, that is, the parliamentary cabinet system after the interim constitution adopted the presidential government, will offer themes of various discussions about future reorganization of the power structure in the Korean constitutional history consistently keeping the presidential system except the parliamentary cabinet system of the Second Republic Constitution since the first constitution of Korea.

이 글은 대한민국 임시의정원의 성립을 근대 의회제도의 도입이라는 측면에서 살펴봄으로써, 임시의정원의 성립이 우리나라 의회제도의 초기 형성에 어떤 영향을 미쳤고, 또한 헌법적으로 어떤 의미를 가지는지 고찰하였다.
임시의정원의 성립은 19세기말 우리나라에서 입헌주의가 싹트기 시작하고, 서구 의회제도가 국내에 소개되기 시작한 것과 무관하지 않다. 이것은 홍범 14조나 독립협회의 의회설립운동, 대한국국제, 각종 신문이나 교과서 등에 소개된 서구 의회제도에 대한 이론적 경험적 이해가 토대가 되었다.
이러한 근대 의회제도의 도입으로 평가되는 임시의정원의 성립은 다음과 같은 헌법적 의의를 가진다. 첫째, 임시의정원은 입법에 관한 권한, 재정에 관한 권한, 대정부 견제에 관한 권한 등 오늘날 대의기관의 권한을 보유하고 행사함으로써 광복 이전까지 실질적인 대한민국 국회의 역할을 수행했다.
둘째, 임시의정원은 그 기능과 역할에 있어서 통상적 대의기관이나 입법기관 이상이었다. 즉 임시의정원은 헌법제정회의 혹은 임시정부의 정당성을 시원적으로 창출하는 기관으로서의 역할을 담당했다. 임시의정원은 스스로 헌법을 제정하고 그 헌법에 따른 입법기관으로서 존속했다.
셋째, 임시헌법, 임시의정원법 등 다수의 관련 규정들은 현행 헌법과 국회법, 국회사무처법 등의 관련 규정과 규범적 연속성을 제공해줄 수 있을 것이다. 임시의정원이 비상국민회의와 국민회의를 거쳐 오늘날 국회로 이어졌는지에 대한 논의에서 벗으나 규범적 차원의 연속성을 검토할 수 있는 소재가 될 수 있다.
넷째, 1919년 임시헌법이 대통령제를 채택한 이후 의원내각제로 변경된 정부형태에서 줄곧 정부가 임시의정원에 책임을 지는 구조는 제헌헌법 이래 제2공화국 헌법상 의원내각제를 제외하고는 대통령제로 점철된 우리 헌정사에서 향후 권력구조 개편에 있어서 보다 풍부하고 다양한 논의의 소재를 제공해 줄 수 있을 것이다.
임시의정원의 헌법적 의의에 대한 이상의 주장들이 보다 타당성을 갖기 위해서는 임시헌법의 제정 과정과 개정 과정 및 개정 내용, 임시헌법 제정에 미친 대내외적 영향, 임시의정원법을 비롯한 관련 법률과 하위 법령에 대한 면밀한 검토, 그리고 이러한 헌법과 법률에 따른 임시의정원의 구체적인 활동이 규명될 필요가 있다.
