The United States amended the Marine Mammal Protection Act(MMPA) and promulgated the rules for the implementation of Fish and Fish Product Import Provisions(August 15th, 2016), which became effective on January 1, 2017. With the entry into force of this regulation, fish and processed fish product caught by fisheries that did not have a comparability finding by the US National Oceanic and Atmospheric Administration(NOAA) until 2021 will be completely prohibited from exporting to the US. Korea is exporting the third largest number of fish products to the US after Japan and China, and if current export items are classified as export fisheries and that cannot be exported, it will inevitably ignite a huge damage.
The various forms of trade control measures adopted by the United States under the current MMPA could be deemed as the most powerful form of import ban. In particular, it seems that it could possibly violate the United Nations Convention on the Law of the Sea(1982) and the WTO Agreement in the sense that it restricts imports of the legally harvested tuna from longline fisheries in the high seas that are regulated and implemented in accordance with the Convention and Conservation and Management Measures adopted by regional fisheries management organizations(RFMOs) under the United Nations Convention on the Law of the Sea. In this context, in Chapter Ⅱ, the legal issue is whether the US MMPA on legally harvested tuna in the Convention area of the regional fisheries management organization constitute an extraterritorial application of US domestic law. And also, to consider the precedents of EU and US extraterritorial application of domestic legal regulations to deter IUU fishing respectively.
In Chapter III, it examines whether the extraterritorial application of MMPA against longline tuna fisheries in high seas can be legitimate in view of the "Objective Territoriality Principle" that applies to cases where certain actions occur outside the territory but the results affect the territory.
In the second part of Chapter III, it considers whether the complete ban on imports of fish and fish products derived from the longline tuna fisheries according to the MMPA is the violation under the WTO Agreement. In particular, it refers the case of EU’s seal product regulation which was brought by Canada and Norway against EU in WTO Dispute Settlement Body. Rulings and reasoning from the case will be applied to our facts to consider whether the MMPA’s regulation meets the standards in GATT Article XX.
