Characteristics of human right after the second world war are revival of natural law, internationalization of human right and socialization of human right. New human right emerged in the name of “a Third Generation Right”. There are a lot of discussions surrounding whether recognizing “a Third Generation Right” or not. There is a skeptical opposition for fear of inflation of human right. But, some kind of third generation right is introduced in renowned constitution textbook and is integral to modern society, into the bargain. Among them, there is an environmental right. Man is both creature and moulder of his environment, which gives him physical sustenance and affords him the opportunity for intellectual, moral, social and spiritual growth. In the long and tortuous evolution of the human race on this planet a stage has been reached when, through the rapid acceleration of science and technology, man has acquired the power to transform his environment in countless ways and on an unprecedented scale. Accordingly, we protect our environment in the form of an environmental right. But this kind of provision is not sure in enhancing the normative power of constitutional law comparing to the provision of state goal. From now on, there should be much more study on which kind of provision is more desirable to enhancing the normative power of constitutional law.
