A sexual crime against children is a serious human-rights violation and a grave crime destroying the foundation of the community. The application of a special process to punish sexual crimes against minors and to relieve victims is the global trend and introduction of various drastic measures to prevent them is also a common phenomenon. Korea has also tried to pursue various policies that would help children and juveniles grow into a healthy member of the society. In particular, GPS monitoring system was introduced to prevent any recurrence of sexual abuse of those who are highly probable of commit crimes again. In the United States of America, State and federal legislators alike responded with harsher, zero-tolerance policies regarding sex offenders, commonly referred to as Jessica's Law. These bills advocate an ingenious system of tracking convicted sexual predator's by using the Global Positioning System. GPS monitoring uses satellites to track offenders. Each offender wears an ankle bracelet and carries a wireless positioning device that periodically transmits the location of the offender. If the offender tampers with the positioning device or enters a prohibited area, the device electronically alerts authorities. With GPS tracking, the monitoring system can identify the location of any given offender at any given moment. California responded to the extensive problem posed by sex offenders to the nation's children by introducing its own version of sex offender legislation that provided for GPS monitoring of offenders. The Sexual Predator Punishment and Control Act, provides for GPS tracking of certain sexual predators, both during their parole and for the remainder of their lives. This note differentiates between the diverse types of legislation that have either been passed or proposed to facilitate effective and efficient ways of protecting innocent juvenile victims from sexual predators. Above all, the GPS tracking system will greatly hinder the ability to prey upon young, innocent children.
