First, freedom of assembly in the US has been protected as an auxiliary means of the right of petition to relieve people's pains, and freedom of assembly in Germany has been protected as the means to express people's opinion of political issue or case in the country. And, freedom of assembly in Korea has been secured as a freedom of expression from the first constitution established in 1948. Next, Supreme Court of the United States declares that prior permit system when an assembly is held is unconstitutional if it is operated at discretion or arbitrarily, and in Germany, assembly or march breaching prior notice obligation is not just dismissed and the assembly or march can be dismissed only in the case that it causes direct danger to public safety and order. Prohibition to permit system of freedom of assembly in constitution of Korea is valid since it is to prevent infringement of freedom of assembly by arbitrary and dogmatic exercise of public power. Last, if the degree of control of noise occurred in assembly is obscure to judge, it is considered unconstitutional against void for vagueness doctrine and due process in the US, The viewpoint to regulate noise naturally occurred with assembly or march by the laws to control environmental noise in Germany is not valid since it is to constraint freedom of assembly being secured by constitution without the law in explicit grounding, that is, by the other laws with different purpose of legislation, ,And, Clause I of article 14, law on assembly and demonstration is the regulation with high unconstitutionality against void for vagueness doctrine and clause 2 of article 14 of the foresaid law is unconstitutional regulation against the principle of minimum infringement in principle of balancing test since it constraints noise naturally occurred with assembly in excessively wide range.
