Even though Artificial Intelligence(hereafter, AI) affects our everyday lives and various fields of society significantly, the reality is that existing legislation is not sufficient to address the challenges posed by AI. Especially, it’s important to find out the legal issues such as civil liability, criminal liability, right to work, copyright and alternatives in order to address these issues. The legal system should handle not only weak AI that we have experienced but also strong AI that we will face. First of all, when it comes to civil liability, Product Liability Act and Civil Act can be applied to weak AI and we should grant legal personality called‘electronic person’to strong AI and manage an obligatory insurance and a compensation fund. Regarding criminal liability, Criminal Act can be applied to weak AI and we can organize the types of strict liability offences and different kinds of punishments to assign criminal liability to strong AI. Moreover, we can introduce robot tax and a basic income system where specific groups receive some money for a certain period of time against the violation of humans’right to work due to the advent of AI. Lastly, the copyright issues about the creation produced by AI can be partially addressed through our Unfair Competition Prevention and Trade Secret Protection Act and Copyright, Designs and Patents Act of UK. However, these acts cannot cover the creation of strong AI. We should consider the legal issues involved AI continually in order to confront the Fourth Industrial Revolution.

인공지능은 우리의 일상생활 및 사회의 다양한 분야에서 그 영향력이 커지고 있는 것이 현실이지만, 이에 대응하는 법제도는 아직 미흡한 실정이다. 특히 앞으로 문제될 수 있는 민사 책임, 형사 책임, 근로의 권리, 저작권 등과 관련한 문제에 대하여 파악하고 그에 대한 대안을 마련하는 것은 필수적이다. 현재 우리가 접하고 있는 약한 인공지능과 더 나아가 강한 인공지능으로의 변화의 상황에 대응할 수 있도록 법체계의 정비가 요구된다. 먼저 민사 책임과 관련하여 약한 인공지능의 경우, 제조물책임법과 민법의 유추적용이 가능할 수 있으며, 강한 인공지능과 관련하여서는 인공지능에 ‘전자 인간’이라는 법적 지위를 부여하고, 이들의 행위로 인한 법익 침해에 대하여 실질적인 책임을 질 수 있도록 의무보험제도 및 보상펀드를 운용할 수 있다. 형사 책임과 관련하여서는 약한 인공지능의 범죄행위의 경우에는 형법을 유추적용 할 수 있고, 강한 인공지능의 경우에는 엄격 책임 범죄를 유형화하고 처벌 방식을 정하여 그에 해당하는 범죄를 저지른 경우 책임을 지우도록 할 필요가 있다. 또한 인공지능의 상용화와 관련하여 인간의 근로의 권리 침해 문제가 대두될 수 있는데, 로봇세 도입을 비롯한 조세 정책의 변화, 대상과 기간을 한정한 기본소득제도의 도입이 그 대안으로 논의될 수 있다. 그리고 인공지능 자신이 만든 창작물에 대한 저작권 문제와 관련하여 부정경쟁방지법, 영국의 저작권법을 참고로 하여 일부 해결할 수 있는 부분이 있으나 강한 인공지능의 경우까지 고려한다면 충분하지 않다. 앞으로 계속적으로 인공지능의 법적 문제와 관련한 고찰이 필요하며, 이는 제4차 산업혁명을 돌파하는 시대적 사명이라고 볼 수 있다.
