Most feminist work focuses on descriptive and substantive representation and the ways in which these two forms of representation may be linked to each other. Especially, critical mass theory assumed that sheer numbers of women have a proportional impact on policy-making around women’s interests. However, it is hard to explain women’s policy changes in South Korea where the ratio of women legislators is lower than 15%. This article revisits the process of the Maternity Protection Law in South Korea based on the critical actor model and the framework proposed by Htun and Weldon and reexamines the relation between descriptive and substantive representation in women’s representation. In this analysis, I found that descriptive representation is not a precondition of substantive representation. Especially, when the ratio of women in legislature is lower than 15%, critical actors who try to represent women’s interests and change them into women’s policies are more important than the ratio of women. In contrast with the assumption of critical mass theory, substantive representation may be a precondition for descriptive representation. In another words, to increase women’s greater descriptive representation, much efforts should have been made to represent women’s interests (substantive representation) by critical actors.

그동안 여성대표성 논의와 분석은 여성의원 수(기술적 대표성)의 증가가 여성친화적인 정책(실질적 대표성)의 실현으로 이어질 것이라는 임계량 이론에 기초해이뤄졌다. 그런데 한국 국회의 여성의원 비율은 임계량 이론에서 제시한 30%의절반도 안 되는 수준에 있으며, 따라서 한국에서 진행된 수많은 여성정책의 변화는 임계량 이론으로는 설명이 불가능하다. 오히려 한국 여성정책의 변화와 진전은핵심 행위자(critical actors) 모델로 설명이 가능하다. 이에 따라 본 연구는 핵심 행위자 모델의 문제의식과 훈과 웰던이 제시한 여성정책 결정모델을 바탕으로한국 모성보호법의 정책결정과정을 재분석하고 이를 통해 여성의 이해가 누구에의해 어떤 조건에서 어떻게 대표되는지, 그리고 기술적 대표성과 실질적 대표성이어떤 관계를 갖고 있는지를 재고찰 한다. 모성보호법 정책결정과정에서 여성운동, 김대중 정부, 국회 환경노동위원회 여야 남녀의원들은 모성보호법 개정을 이끄는 핵심 행위자 역할을 수행한 반면, 한나라당과 자유민주연합, 이들 정당에 소속된 남성의원들, 기업가 집단은 모성보호법의 개혁성과 내용을 축소시키는 데 있어 결정적 역할을 했다. 이들 행위자 간의상호작용에 있어 경제위기와 여소야대 구도는 모성보호법을 반대하는 행위자들에힘을 실어줘 모성보호법 개정에 부정적인 영향을 미친 반면, 진보적 정권으로의교체는 모성 이슈의 재의제화와 모성보호법 개정에 긍정적인 영향을 미쳤다. 이러한 분석내용은 실질적 대표성을 실현하는 데 있어 반드시 일정 비율(임계량)의기술적 대표성이 전제될 필요가 없다는 것을 보여준다. 그리고 기술적 대표성의증가가 실질적 대표성의 증가로 이어지기 위해서는 역으로 핵심 행위자들에 의한실질적 대표성 증진의 경험이 임계량에 도달하기 이전부터 실천되고 축적될 필요가 있다.
