This study is to look into how the amnesty that forgives or reduces penalty for prisoners occurred at the end of Goryeo dynasty and the issues that arise from the punishment operation system.
First the starting point of the end of Goryeo dynasty has been set at the establishment of Military Rule and have considered the amnesty enactment throughout till the annihilation of Goryeo dynasty. Especially, it analyzes the period in detail in terms of the status change of the king’s right that had a decisive role in pardon enactment.
The first period was the Military rule period. The reason why there were lots of changes in the amnesty is that the operation changes in the punishment field went through lots of changes. The king’s status of his decisive right on amnesty has gone weak and the military rulers’ legal right has strengthened.
The second period is the Period of Yuan Intervention in Goryeo. During this period, the political intervention of Yuan affected the amnesty and the Mongol goverment’s announcement has been applied to the Goryeo dynasty. The official amnesty announcement from Goryeo followed. Therefore, the amnesty was enacted based on a overlapping structure that can’t be seen in other periods.
The third period is the last stage period when the anti-Yuan reforms claimed by King Gongmin to the end of the Goryeo dynasty. All kings during thisperiod did not rise to its throne through a normal process. They risen to its throne with a political outburst. Therefore, the amnesty they announced were used as political purposes. Lots of issues arose due to its events. Accordingly, a revolutionary plan has been submitted.

죄수를 용서하거나 형벌을 감해주는 사면이 고려 후기에 들어와서 어떤 양상으로 실시되었는지를 결정권을 지닌 국왕의 위상 변동과 연동시켜 시기를 구분하여 각각의 특징을 분석하였다. 각 시기마다 실시의 추이를 표로 작성해서 보다 심화된 연구의 토대를 마련하는 것과 더불어 시대별 특성 파악에 초점을 두었다.
후기의 출발점인 무신집권기부터 왕조의 말기에 이르기까지 다양한 명목으로 사면이 단행되었다. 각 시기마다 통치 체제의 운영과 왕권의 행사 방식 등이 바뀌면서 내용이나 형식, 외형 등에도 변화가 일어났으며, 이는 곧 성격의 변모로 연결되었다.
첫 번째 무신집권기인데 위상이 약화된 국왕 대신 무신 집정이 주도하면서 실시의 양상이 달라졌다. 정권의 속성상 형식이나 외형적 틀은 본래의 모습을 유지시켰으나 내용면에서 많이 바뀌었다. 갑작스런 정권 교체에 따른 불만의 해소와 함께 집권 세력의 안정화에 기여토록 운용되었다. 한편 시간이 흐를수록 대외 관계의 영향을 받으면서 다음 시기인 원간섭기의 현상이 나타나기 시작했다. 특히 후반부로 갈수록 고려 전기의 사면 실시에서 자주 등장하였던 요소들은 줄어들었다. 그 대신 후반기에 들어와 비로소 출현하였던 것들이 서서히 비치기 시작했다. 즉 전환되어 가는 모습이 보였다.
원간섭기에 이르면 몽골과 고려의 양측에서 선포하는 사면령의 적용을 받게 되었다. 그로 인해 사면 실시에 있어 이 시기만의 독특한 양상이 전개되었다. 이중으로 적용되는 가운데 용어를 비롯한 여러 부문에서의 차등화가 실행되었다. 그것은 특히 원의 형법으로 처벌 받은 자는 고려 자체의 사면 대상에서 제외되는 것을 통해 구체화되었다. 심지어 선포 의식이나 의례 등의 형식, 외형적인 면까지도 바뀌게 만들었다. 그 결과 성격의 변화까지 초래되었다.
공민왕 5년 6월 반원 자주 개혁이 추진되면서 재차 큰 변화가 야기되었다. 정치 상황이 복잡해지면서 통치 체계도 혼란에 처했는데 이런 현상은 왕조의 말기까지 지속되었다. 왕권 행사의 파행성이 커지면서 사면의 실시에도 여러가지 문제가 발생했다. 남발에 따른 불공정 등의 논란이 일어나면서 오히려 정치적 갈등을 유발하는 것으로 인식되었다. 인심의 무마가 아닌 불만의 대상이 되었다. 마침내 정략 수단의 하나로 전락되었다는 비판이 제기되었다. 결국 개혁의 대상이 되기에 이르렀다.
