China’s international investment treaty policy has now entered a new phase in its evolution of practices and role. The Chinese government is upgrading its investment treaty practices by accepting substantially the standards in the U.S. model BIT, including pre-establishment national treatment with a negative list and prohibition of performance requirements. The Chinese government is also pursuing a leading role in international investment-related rule making in global forums such as G20 and WTO. This paper presents these new aspects of China’s investment treaty policy and discusses their backgrounds. In order to achieve the goal of ‘New Normal’ economic growth, China needs to further open up the scope of foreign investment to attract such investment in high-tech manufacturing and services. China needs to deepen economic reforms and a high-standard investment treaty is expected to work as an external pressure to facilitate domestic reform process. China’s outbound foreign investment has surged in recent years, surpassing inbound investment. To protect the interests from the standpoint of a major capital exporting country as well as capital importing country, the Chinese government needs to actively initiate and coordinate intergovernmental discussions to improve global governance for investment-friendly environment.
