The number of senile dementia with high dependance requesting long term medical care over 10 years increases rapidly according to aging society. With the adoption of new politics for dementia, the number of facility will increase. However, the regulation for the aged human rights among the weakest part in devoid of mental capacity or lack of power of judgement is not yet well prepared. So the social interests in the human rights of the aged dementia living in the facilities are required the more. Especially, the aged dementia who needed to be taken medical care of long term is required for the regulation of being able to be treated well and raise the quality of facility in day care, short term care, long term care. Therefore, this paper is to find the method for protect the human rights of Korean aged dementia after considering the regulation for the aged human rights through human right regulation, reason for violation of human rights, and the concepts of human rights. So from now on, this study was proposed to establish of the adult guardian law or revise on act for the aged in order to human rights protection for dementia senile in Korea.
