This article explores the ways in which the issue of gender-based violence has been dealt with especially in terms of hate crime. Within the context of the Gangnam murder case which triggered debates on misogyny and mental illness as a cause of the incident in Korean society, this article aims to answer the question of why gendered violence should be treated as bias-motivated hate crime. Firstly, this article points to the motivations and consequences of hate crime are similar to those of gender-based violence. Secondly, it discusses some tensions and differences in interpreting violence against women as hate crime by categorizing some shared or distinguished figures including intentions and evidence of the crime, interchangeable victims, and unconscious motivations, Especially, by reinterpreting the concept of interchangeability of victims, this article argues that it is possible to understand victims of intimate partner violence as those of hate crimes because any woman who is in a relationship with the perpetrators can be a target of violence. If the fundamental cause of violence against women is due to the desire to control and terrorize women, it also argues that gender-based violence is motivated by a hatred of women. Finally, this article sheds light on the advantages and interests when violence against women is considered as hate crime.
