Although hate crimes were encountered with the history of human, recently in case of USA is coping with criminal policy. Hatred caused by hate or bias has been in the primitive society, of course even today which has been the cause of a curse opponents. Especially nowadays it has to be a crime against a individual or groups increasingly. These hate crimes are distinct difference in the concept between Korea and USA. In case of USA, hate crimes are confined to crimes caused by race discrimination, religious bias, sexual orientation bias, ethnic minority or nation origin, disability, in fewer states gender discrimination. these hate crimes are to be legalized as hate crimes by Hate Crime Statistics Act in 1989, and are punished more severly in comparison to other crimes by Hate Crimes Sentencing Enhancement Act in 1994. Legally FBI is managing a special data collecting program by Hate Crime Statistics Act. Almost police department established a special unit to investigate hate crimes and has educated special investigators. This study appreciates the presence of hate crimes in all natins including Korea. Korea authorities have not classified the pattern of hate crime legally and have not legalized the laws concerning hate crimes. In Korea, hate crime is predicted to happen in future highly because foreign, homosexuals and homeless is increased too highly. So countermeasures are needed against hate crimes.
