Violence against women is a transnational issue that affects the well-being of every single individual and community and the development of every country at multiple levels and aspects. In Vietnam, government and myriads of non-governmental organizations have been sharing great efforts to combat violence against women, especially domestic violence. In November 2007, the Vietnamese government ratified Law on Domestic Violence Prevention and Control to prevent domestic violence; protect and support victims; outline responsibilities of individuals, families, agencies, and organizations involved; and provide for the handling of violations concerning domestic violence. However, the fact shows that justice for abused women remains difficult to access. Most of victims of domestic violence do not report to police or seek help from the courts due to many reasons. From the perspective of an antiviolence activist, I understand that the justice system alone cannot keep women safe and meet their needs. This paper focuses on an alternative practice referred to as “restorative justice” which is proposed as a new solution to domestic violence issues. It helps to coordinate victim-offender dialogue where the victim describes the impact of the offence and what might be needed for healing while the offender is aware of and accepts responsibility for violent actions and to make amends. Restorative justice practice also involves community as a vital party to support the victim with recovery and to assist the offender with rehabilitation. Ultimately, it aims towards a balance between serving the state’s role in controlling and decreasing harmful behaviors and the victims’ concerns in preserving dignity, communicating with their partners and rebuilding a healthy family life.
