Industrial Accident Compensation Insurance in Republic of Korea(IACI) is compulsory insurance provided by the government to protect the employees injured in and industrial accident and his/her dependent. The Insurance shall be applicable to all business or workplace, but there had been a debate to apply a quasi-employee, the boundary between employee and independent contractor. The regulation in force provides a special exceptions for quasi-employee, Controversy continued around the concept and scope of it in IACI.
In such situation, I try to introduce Industrial Injuries Scheme in UK(IIS) for finding policy implication of a reorganisation on the scope in IACI. For this purpose, I examine a systemic features in IIS and a range of application. Employed earner, the standard of IIS, menas a person who is gainfully employed in UK under a contract of service, or in an office with general earnings. The concept of ‘employed earner’ is wider range than employee or worker, the standard of employment rights in the workplace. Considering a identity of social insurance, there should not necessarily be equal the standard of application between labour law and social security law. Another figure that does deserve highlighting is the role of Her Majesty"s Revenue and Customs(HMRC) collecting agency to social insurance contribution. HMRC is a non-ministerial department of the UK Government responsible for the collection of taxes, the payment of some forms of state support, and the administration of other regulatory regimes including the national minimum wage. For scope of Industrial Injuries, HMRC plays an important role determining who is employed earner or not. It has an influential role for preventing unnecessary judicial disputes about IIS for a actual authority of a administrative agency.
