On June 30, 2007, a free trade agreement was concluded between Korea and the United States after a long tug of war. It is a long way off the ratification in light of the public opinions extremely divided down to date on the conclusion of the Korea US FTA in the United States as well as in Korea. However, such conclusion of the Korea US FTA will eventually make the interchange with the United States to become more active and cause significant changes in the whole aspects of the domestic industries. The Korea US FTA provisions in re1ation to the culture industry include, inter alia, reenforcement of the copyright or related right ho1ders` rights such as extension of the protection periods, reenforcement measures to prevent copyright infringements such as new establishment of technical protection measures for access control, reenforcement of the enforcement phase of the intellectual property rights such as introduction of the pre-established damage scheme, reenforcement of punishment of intellectua1 property rights infringers such as expansion of offences that do not need aforma1 complaint from right holders for prosecution and reduction of screen quota. This article is to examine the repercussions which the Korea US FTA will have on the whole aspects of domestic culture industries and as a countermeasure to such repercussions, provide suggestions as to a plan to improve systems as well as laws and regulations, improve the system to develop the copyright industry and revigorate its use, work out a countermeasure to promote the digital cultural content industry and prepare a basis for globa1 expansion of the Korean Wave. The Supporters and opponents of the Korea US FTA have thus far focused on the prevention and minimization of any damage from it on the assumption that we will no doubt sustain damage, however, it is hoped that the conc1usion of the Korea US FTA would serve as a momentum to get out of the negative perception and positively utilize it.
